The Department of Veterans Affairs operates under a complex framework of federal statutes, regulations, and administrative procedures that govern how veterans’ benefits are administered. When these policies are misinterpreted, improperly implemented, or applied inconsistently, veterans can be denied the benefits Congress intended them to receive.
Military-Veterans Advocacy works to ensure that VA policies and procedures are implemented lawfully, transparently, and in accordance with federal law. Through legal advocacy, regulatory engagement, and policy analysis, we seek to protect veterans’ rights and improve the systems responsible for delivering benefits.
Our work focuses on identifying systemic problems within the VA’s rulemaking and adjudication processes and pursuing corrective action when policies conflict with governing statutes or established legal standards.
How VA Policy Is Created
VA policy is shaped through a combination of:
Federal Statutes
Laws passed by Congress that establish eligibility for benefits and define the VA’s legal authority.
Federal Regulations
Rules issued by the Department of Veterans Affairs and published in the Code of Federal Regulations (primarily 38 C.F.R.).
Administrative Procedures
Internal policies, adjudication manuals, and procedural guidance used by VA personnel to process claims and appeals.
Judicial Decisions
Rulings from the U.S. Court of Appeals for Veterans Claims, the Federal Circuit, and other courts that interpret veterans law and define the limits of VA authority.
These layers of authority must work together to ensure veterans receive fair and timely decisions on their claims.
Where Problems Occur
Even when Congress clearly defines veterans’ benefits, problems can arise when:

Submitting formal comments during the federal rulemaking process to challenge harmful policies and advocate for improvements.

When policy changes cannot be resolved administratively, MVA pursues litigation to enforce statutory protections and prevent unlawful regulations from harming veterans.
Legislative Engagement
Working with members of Congress to identify statutory corrections needed to fix systemic problems in veterans benefits law.
