Legislative Recognition of Offshore Service
For many years, veterans who served aboard U.S. Navy vessels operating offshore during the Vietnam War were excluded from the Department of Veterans Affairs’ presumption of herbicide exposure.
While veterans who served on the landmass of Vietnam or within inland waterways were generally eligible for the presumption of exposure to Agent Orange, many sailors who served in the waters off the Vietnamese coastline were denied similar recognition.
This distinction created significant challenges for veterans seeking disability benefits related to herbicide exposure.
The Blue Water Navy Vietnam Veterans Act of 2019
In June 2019, Congress enacted the Blue Water Navy Vietnam Veterans Act, expanding eligibility for VA disability benefits for veterans who served aboard naval vessels operating within the territorial sea of Vietnam.
The law extended the presumption of herbicide exposure to veterans who served within 12 nautical miles of the Vietnamese coastline during the Vietnam War.
This legislation represented a major policy change affecting thousands of Navy veterans and their families.

Why the Legislation Was Needed
Prior to the passage of the 2019 law, many veterans who served offshore were required to prove direct exposure to herbicides, which was often difficult due to the passage of time and limited documentation.
Advocates, veterans’ organizations, and researchers argued that naval vessels operating near the Vietnamese coastline were exposed to the same environmental conditions affecting service members on land.
Years of advocacy, legal challenges, and congressional debate ultimately led to passage of the Blue Water Navy Vietnam Veterans Act.
Geographic Standards in the Law
The legislation incorporated the internationally recognized 12-nautical-mile territorial sea boundary as the geographic standard for determining eligibility.
This standard recognizes the territorial waters of Vietnam and extends eligibility for the presumption of herbicide exposure to veterans whose ships operated within that zone.
Historical naval records, including deck logs and ship location data, can sometimes help determine whether a vessel operated within this area during the war.
Continuing Policy Issues
Although the Blue Water Navy Vietnam Veterans Act resolved many long-standing issues, questions related to toxic exposure, geographic interpretation, and the application of presumptive conditions continue to evolve.
